What should I do if I've been injured on the job?

Workers’ Compensation for Traumatic Injuries in Monmouth County

Many years ago, injuries sustained on-the-job were considered collateral damage, a price workers had to pay for the privilege of employment. However, as our nation progressed, the health and safety of American workers became an important issue. Today, workers who are injured while at work have rights and are entitled to compensation. Under present New Jersey Workers’ Compensation law, a workplace injury may even include accidents that occurred while traveling for work or at a company 

social function.

Often, workers that have been injured on the job are told by their employers to apply for short-term disability insurance benefits.  These benefits are inferior to Workers’ Compensation benefits. Unlike short-term disability benefits, Workers’ Compensation benefits are not subject to income tax and they are typically paid out in a higher amount and for a longer period of time.

Depending on the facts of your case, you may be entitled to:

• Medical benefits – Your employer’s insurance carrier should cover all of the reasonable and necessary medical 

  expenses, including hospital services, doctors’ appointments, physical therapy, follow-up treatment and prescriptions incurred 

  by your workplace injury.

• Temporary disability benefits – If you are disabled for more than seven days, you may qualify for payment of part 

  of your wages until you are able to return to work or have reached maximum medical improvement (MMI).

• Permanent partial benefits – If your workplace injury results in partial permanent disability, you may receive 

  weekly benefits after your temporary disability benefit period ends.

• Permanent total benefits – If your disability prevents you from returning to gainful employment, you may be 

  eligible for income compensation for as long as you are disabled.

• Death benefits – Dependents (typically spouses and minor children) of workers who were killed in a workplace accident may 

  qualify for a part of the income their deceased family member would have received.

By collecting Workers’ Compensation benefits, you relinquish your right to sue your employer. However, if you were injured by a person other than your employer, you may be able to recover from the third-party in a personal injury claim in addition to collecting Workers’ Compensation benefits. If this is the case, it is important to know that you may be subject to a lien against your third-party lawsuit award to repay the support you were provided through Workers’ Compensation.
